Human Right to Science

The Human Right to Science, initially recognized in article 27 of the Universal Declaration of Human Rights and
article 15 of the International Covenant on Economic, Social and Cultural Rights, includes, among others, the right to participate in cultural life, enjoy scientific progress and its applications, benefit from the protection of moral and material interests arising from any scientific, literary or artistic production of which the individual is the author. The advent of the internet and the use of Information
and Communication Technologies in various areas of science have driven significant changes, including in the way of production, communication and human appropriation of scientific knowledge. Despite the work of the open science movement and the advances it has demonstrated in recent years, there are still many challenges and perspectives that arise in the context of the digital era,
regarding the democratization of knowledge in Brazil. The objective of the research was to analyze how the constitutive aspects of the Human Right to Science are reflected in the jurisprudence of the Federal Supreme Court (STF) of Brazil. This is research with a qualitative and descriptive approach, focused on the documentary analysis of three judicial decisions. The results point to a strong
connection between the Human Right to Science and other fundamental rights, such as the right to health, the right to the
environment and freedom of thought and access to information. It was concluded that the effectiveness of the Human Right to Science arises from the commitments made by the Brazilian State, together with the United Nations. Furthermore, in order to implement the aforementioned right, the Brazilian State is faced with challenges and opportunities related to the digital inclusion of historically marginalized social groups and the opening up of science as a whole.
